Many of our homeowners have inquired over the last two years as to the status of the Eastridge Meadows HOA from 2013 through today. This deserves some clarification.
In 2013, a previous HOA board had mistakenly failed to file the annual HOA documents with the Missouri Secretary of State. This resulted in the HOA being dissolved as of 12/18/2013. When this error was discovered by a later HOA board of directors in 2015, they immediately contacted state authorities to determine how to rectify the situation.
The office of the Missouri Secretary of State instructed the HOA board to submit valid HOA filings for 2013, 2014, and 2015, as well as remit the required annual filing fees, and present an application requesting rescission of the previous dissolution. On 5/29/2015, the Missouri Secretary of State issued the Certificate of Rescission for the previous dissolution of the Eastridge Meadows HOA, restoring the HOA to active status as of 12/18/2013 forward.
There are two important results of this rescission. First and foremost, the original HOA Bylaws, Covenants, and Restrictions remained in effect. Those remain posted on the HOA website for public inspection. Second, all HOA members who owned properties from 2013 through 2015 remained responsible for payment of annual HOA dues of $50 per year for those years.
Since 2015, the annual filing documents and fees have been filed with the Missouri Secretary of State. Today, the HOA remains active with a continuous history from its original inception in 2001.
To be clear, there is no situation with the dissolution of the Eastridge Meadows HOA nor with the rescission of dissolution nor with any other legal proceedings outstanding with city, county, or state officials that would exempt homeowners from paying their annual HOA dues from 2013 through today.
Documents are available for inspection both with the Eastridge Meadows HOA Board and with the Missouri Secretary of State.
